Terms & Conditions

Effective 30 June 2026. These terms govern all access to and use of NotateAI, operated by the Company, a corporation organized under the laws of the State of Delaware.

Welcome to NotateAI. By registering for, accessing, or using our platform, browser tools, AI copilot engines, or task evaluation sandboxes (collectively, the "Services"), you enter into a legally binding contract with NotateAI ("the Company", "we", "our", or "us"), a corporation organized and existing under the laws of the State of Delaware. If you do not agree to these Terms & Conditions, you must immediately discontinue all use of our Services.

  • You must be at least 18 years old or the age of majority in your jurisdiction to establish an account.
  • Your continued use following any periodic updates signifies unconditional acceptance of revised terms.
  • Corporate or enterprise accounts represent and warrant that the authorizing individual holds requisite signatory authority.

To access our copilot annotation suites, token allowances, and multi-model tools, you must create a registered account with accurate, current, and complete information. You are solely responsible for safeguarding your authentication credentials and API access keys.

  • Account sharing across independent evaluators is strictly prohibited without multi-seat authorization.
  • You must notify doe@notatehq.ai immediately upon discovering any unauthorized account breach.
  • The Company reserves the right to suspend or terminate accounts that provide fraudulent or synthetic identity data.

NotateAI operates on a transparent token and subscription economy. Users select plans (such as Starter, Pro Annotator, or Super Annotator) or discrete token allowances to power AI inference, synthetic reviewer cross-examinations, and evaluation assistance.

  • All prices are listed in United States Dollars (USD) and exclude applicable local sales taxes.
  • Plans and token packages are provided on transparent terms without hidden fees or surprise charges.
  • Due to immediate provisioning of compute resources across integrated foundation model clusters, consumed compute and tokens are non-refundable once inference execution commences.
  • Unused tokens remain active on your account in accordance with plan terms unless terminated for policy violation.

NotateAI is an independent productivity suite and assistive intelligence sandbox designed for freelance data annotators, AI evaluators, and prompt contributors. We are not officially affiliated with, sponsored by, or endorsed by third-party data annotation platforms, freelance client marketplaces, or AI research labs.

  • You retain ultimate contractual responsibility for adhering to the specific client guidelines and rubrics of your third-party contracting platforms.
  • NotateAI functions as a human-in-the-loop verification aid; human annotators remain the authoritative ground truth.
  • All third-party trademarks, company names, and logos cited on NotateAI belong strictly to their respective owners.

You retain full ownership and intellectual property rights in and to the specific human reasoning, annotations, and evaluation justifications that you create using our tooling. The Company does not claim copyright or title to your human evaluation outputs.

  • The Company retains all rights, title, and interest in our proprietary algorithms, user interface designs, and platform architecture.
  • We do not sell customer evaluation inputs or use customer proprietary prompts to train public foundation models without explicit consent.
  • Model outputs generated by integrated third-party foundation models are subject to their respective upstream terms.

The Services are provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, the Company disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

  • Under no circumstances shall the Company or its officers, directors, or employees be liable for indirect, incidental, punitive, or consequential damages.
  • Our cumulative aggregate liability for all claims arising out of these terms shall not exceed the greater of $100 USD or the total amount paid by you to the Company in the 3 months preceding the event.

These Terms and any dispute or claim arising from your use of the Services or relationship with the Company shall be governed by and construed in accordance with the laws of the State of Delaware and the applicable federal laws of the United States, without giving effect to any choice or conflict of law principles.

  • Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be resolved through binding arbitration administered in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) in the State of Delaware.
  • You agree to resolve all disputes strictly on an individual basis and explicitly waive any right to participate in or initiate class-action, collective, or representative proceedings.
  • To the extent court litigation is permitted, the state and federal courts located within the State of Delaware shall have exclusive venue and jurisdiction.

We utilize user data solely to provision inference, calculate token balances, detect abuse or security threats, and optimize responsiveness.

  • We DO NOT sell your personal information or evaluation prompts to third-party data brokers or advertisers.
  • We DO NOT use proprietary customer evaluation tasks to train public open-weights foundation models without explicit affirmative consent.
  • Evaluation prompts transmitted to third-party model inference providers are passed via enterprise zero-retention API configurations wherever available.

Depending on your state or jurisdiction of residence, you may possess specific statutory rights regarding your personal information under applicable state and federal laws.

  • Right to Know & Access: You have the right to request disclosure of the specific categories of personal data collected, sources, and commercial purposes.
  • Right to Delete: You have the right to request erasure of your personal data, subject to legal compliance, fraud prevention, and operational retention exceptions.
  • Right to Correct: You may request rectification of inaccurate personal details stored in your account profile.
  • Right to Opt-Out of Sale / Sharing: Because we do not sell or share personal data for cross-context behavioral advertising, your personal data is not monetized.

NOTATEAI COMPLIANCE & SAFETY

Acceptable Use Policy (AUP)

Effective 30 June 2026. Establishing the standards of conduct, safety boundaries, and prohibited activities across NotateAI services.

NotateAI is intended for legal, professional, and ethical AI evaluation assistance. Permitted activities include evaluating multi-model responses, cross-examining machine hallucinations, validating image/video annotation boundaries, and sharpening evaluation rubrics.

  • Assisting human annotators in formulating rigorous, evidence-based critique.
  • Conducting comparative model benchmark analysis across supported LLM clusters.
  • Testing synthetic reviewer rubrics within approved educational or freelance workflows.

You agree that you will not use NotateAI to generate, store, or transmit content that violates applicable federal, state, or international laws.

  • Malicious Prompts: Crafting jailbreaks designed to bypass foundation model safety guardrails or generate instructions for cyberattacks, weapons, or physical harm.
  • Exploitative Content: Generating child sexual abuse material (CSAM), non-consensual sexual imagery, or harassment vectors.
  • Automated Abuse: Using unauthorized scrapers or bots to artificially exhaust evaluation quotas or spoof referral rewards.
  • Identity Spoofing: Impersonating platform staff, research labs, or other evaluators.

Users shall not decompile, reverse engineer, disassemble, or derive the underlying source code, proprietary algorithms, or evaluator logic of NotateAI.

  • You may not probe, scan, or test the vulnerability of NotateAI infrastructure without written authorization.
  • You may not resell, sub-license, or redistribute platform API access without an approved enterprise partnership.

NotateAI maintains automated safety monitoring and compliance auditing. Suspected violations may result in token forfeiture, temporary account suspension, or permanent termination.

  • Serious violations involving criminal endangerment will be reported to appropriate law enforcement authorities.
  • Inquiries or appeals may be submitted to doe@notatehq.ai within 14 calendar days of sanction notice.

  • The annotator remains solely responsible for the accuracy and veracity of any final evaluation submitted to contracting platforms.
  • Copilot analysis should be treated as an advisory second opinion, subject to human scrutiny and verification.
  • Evaluators must actively verify model citations and facts before adopting them into client justifications.

Submitting automated, unverified LLM output as genuine human evaluation degrades model training datasets and directly endangers evaluator platform standings.

  • Never copy-paste raw LLM outputs into third-party evaluation rubrics without critical review.
  • Utilize the multi-model comparison tools to identify subtle logic discrepancies rather than accepting first-pass claims.
  • Maintain independent domain expertise in your specialized annotation modalities (coding, math, creative writing, video analysis).

Third-party contracting evaluation platforms enforce detailed, project-specific rubrics. Annotators must ensure that custom client constraints supersede generic model assumptions.

  • Where client rubrics mandate specific formatting, follow client specifications without deviation.
  • Respect client confidentiality: never upload confidential source code or unreleased client model outputs into unapproved public chat sandboxes.
